ASC sanctions energy exec for making untrue statement to investigators

first_img PwC alleges deleted emails, unusual transactions in Bridging Finance case BFI investors plead for firm’s sale Facebook LinkedIn Twitter Securities regulators in Alberta have ordered $32,500 in monetary sanctions against an energy company executive who was found to have lied to investigators. But they rejected a bid for heavier sanctions from regulatory staff. The Alberta Securities Commission (ASC) ordered Edmund Shimoon, chairman and CEO of Calvalley Petroleum Inc., to pay an administrative penalty of $25,000 and costs of $7,500, after a hearing panel found that he breached securities laws by making an untrue statement to ASC staff in the course of an investigation. However, the panel dismissed all of the other allegations made against Shimoon and others in the case. Share this article and your comments with peers on social media James Langton center_img Keywords EnforcementCompanies Alberta Securities Commission According to the decision, ASC staff sought a penalty “in the range of $50,000-$75,000”, and a one-year ban from acting as an officer or director of any reporting issuer, against Shimoon for the one allegation that was proven. It says that Shimoon argued that staff’s proposed sanctions were “unreasonable and unnecessary”, and that a director-and-officer ban would be particularly “unreasonable and disproportionate”. He suggested that a penalty in the $10,000 to $20,000 range would be more reasonable. And, the panel largely agreed with Shimoon. While it ruled that some sanction is necessary, given “The nature and seriousness of the misconduct found here, and the foreseeable serious adverse effects that a repetition could have on the investigative process”; it ultimately decided that a director and officer ban was not warranted, and that a smaller penalty than the one recommended by ASC staff is appropriate. “We are not convinced that the deterrence needed here — and the intended encouragement of future forthright behaviour — demand Shimoon’s removal as a director and officer, even temporarily, of Calvalley or any other issuer,” it says. “To the contrary, in the circumstances of this case we consider that the bans sought by staff could amount to punishment rather than protection.” “The clearest, simplest and in our view most effective mechanism would be a monetary order – an administrative penalty. We are satisfied that an administrative penalty — alone, and in an appropriate quantum — will suffice in this case,” it concluded. Jott’s Move From Free to Premium – Bait and Switch or Good Business?

first_imgTags:#business#enterprise#web 8 Best WordPress Hosting Solutions on the Market jason rothbart Many Web 2.0 companies have tried to make money by charging for their product, but it can be hard work – especially if the product started out as free. Jott, a voice to text transcription service, is an example of one that took the plunge and succeeded. Jott moved to a paid model following a successful free beta. I spoke with Jott CEO John Pollard to learn how they did it and how it is working out for them.Jott is a great tool if you haven’t tried it. It is a voice-to-text service where you call a number on your phone, dictate a note, schedule a meeting, or write a to-do and the service transcribes your voice into the appropriate message type; it even creates an object on Outlook automatically. The service had been in “beta” status and completely free. Recently, they came out of beta and rolled out a paid model with multiple plans for different usage and features. Jott still has free service, but it’s been put together such that if you are a frequent Jott user, you’ll be very tempted to upgrade. The upgrade itself is less than $4 so I suspect many people will go for it. Jott has a variety of plans to choose from including free, basic, pro, pay-as-you-go, etc.The company based these plans largely on user behavior and lots of data. When they started the company, they knew they would ultimately have a free and paid version, but had to learn the rest along the way. For example, they had to find out if their customers were home makers, road warriors, students, professionals, etc. Some of the factors they experimented with during the beta program included turnaround times, length of recordings, and features. By collecting data around user behavior and usage, they were able to model scenarios and identify trends. They then used focus groups, the Jott user group, and conjoint analysis (a very cool survey technique requiring users to make trade-offs on product features versus price) to come up with the different packages. They were very confident that some professionals wouldn’t want an ad-supported service, and the research confirmed it.As you can imagine, they overcame significant challenges along the way. While many users understand that Jott has to put food on the table, there were users who were shocked that a company dare ask for money. Personal note: this is both a common and ridiculous sentiment that has grown as more “free” things pelt us, but that is a conversation for another day.John and company decided to be extremely transparent about the process and spent significant time in their forums, hitting the blogs, and using other marketing mechanisms to tell their story and let users know what was going on. John admitted they could improve on the communication front, but they did a solid job. The communication philosophy was to tell the users what was coming, tell them when it was coming, and explain why – as many times and in as many places as they could. The company is very pleased with the conversion process so far. They are apparently hitting their goals and on plan. One pleasant surprise according to Jott is the percentage of people selecting annual plans; John said they are getting 10 times the number of annual subscribers that they expected. I’m not surprised as I’m sure a large percentage of Jott users are business customers, and this is the most efficient way to get something expensed; although this is pure speculation on my part. John has good advice for other companies embarking on this journey. First, talk to your customers as much as possible. Really talk to them and understand the problem you are trying to solve and how they use the product or service. Second, utilize web-based tools like conjoint analysis to gather quantitative information to make decisions. Finally, try to be transparent and don’t surprise your customers; they hate that. If you build something that people want and value, you can ask them for money and it is good business. Nehalem-EX will bring a lot to the RISC party

first_imgNehalem-EX goes into production later this year and I am pretty excited about how it will change the game. What do you think? Improved bandwidth. Up to 9 times memory bandwidth of previous generationsIntroduction of Quickpath Interconnects to the EX systemsAdd new RAS features previously seen on Itanium products to Xeon productsSignificant improvement in performance vs previous generations e.g. Database 2.5xeMore scalable platforms through 8 OEMs offering >8S. These platforms are key to manage large databases and for large scale consolidationMainframe class availability in scalable platforms I wrote a while back about how the Xeon 7400(Dunnington) processor series compared to RISC. Since then I have shared information through other blog posts and sharing content about how Xeon 7400 and Xeon 5500 will compare to both SPARC and POWER.Xeon 7400 and Xeon 5500 are the current products shipping into the marketplace today. I.M.H.O they offer a pretty compelling alternative from both a performance and TCO perspective Vs SPARC and POWER. But I will not try and repeat all the reasons hereWhat I wanted to share with you was some thoughts about what the next product to succeed Xeon 7400 will bring to the RISC party. Nehalem-EX is the code-name for our next generation of product designed to serve workloads currently serviced by Xeon 7400 today (i.e. Database, ERP,  BI etc). EX btw is what we all would traditionally call MP or multi processor serversDon’t stop reading now, here is why I’m EXCITED about what Nehalem-EX will bring to the RISC party. My excitement is actually based on real customer discussions about what Nehalem-EX will do for them and why it delivers some new stuff (my code for features and benefits) which they see as a pre-requisite to make the move from RISC to Xeon. For some customers the TCO and performance of  products have been enough to convince them to move. For some other customers there are still some checkboxes remaining which I believe Nehalem-EX will addressHere is a snapshot of some of the cool new stuff which is actually convincing customers (from some real deals that I have worked)center_img For more information check out the press briefing from May. Pioli: ‘Milan on a par with Juve’

first_img Watch Serie A live in the UK on Premier Sports for just £11.99 per month including live LaLiga, Eredivisie, Scottish Cup Football and more. Visit: https://subscribe.premiersports.tv/ Stefano Pioli insists Milan “were at least on a par” with Juventus in the 1-0 defeat, but again paid the price for not taking chances. “We need results now.” This was probably the best Rossoneri performance of the season so far, with a series of Wojciech Szczesny saves on Krzysztof Piatek, Hakan Calhanoglu and Lucas Paqueta. However, Juve substitute Paulo Dybala got the decisive goal with a moment of magic as he dribbled past Alessio Romagnoli to drill home. The 1-0 result means Milan have now lost their last nine Serie A trips to Juve and are only four points off the relegation zone. “We put in the performance, were at least on a par with our opponents, if not more, but if you don’t turn those chances into goals, you are going to pay,” the coach told Sky Sport Italia. “We’ve got to keep working and improving. Our current position is unworthy of Milan and that must keep us worried and concentrated at all times. “Unfortunately, it’s the same thing I said last Sunday after Lazio, which is that we had the opportunities and I don’t think many have 15 shots on goal the way we did at the Juventus Stadium, but we need to convert more of them. “We also conceded a goal when we should’ve been tighter in our defending and marking. I can only underline that the performance is good, but we need the results too. We have to improve our position in the table, it’s time to take some punches and work hard. “I see improvements every day, I saw them in recent matches, as we were by no means inferior to Lazio or Juventus. We must understand that at this level, every single ball can be decisive. “We haven’t had as many points as we expected, nor as many as we probably deserved lately, but the performances have been there.” Pioli tested out the three-man defence in training this week, so can that be a solution for the near future? “I don’t think so.”last_img read more
